Terms and Conditions

§ 1 Scope
These general terms and conditions apply to all orders placed through the online shop of Maria Maria Wines GmbH, Elberfelder strasse 78d, 40822 Mettmann (hereinafter "Maria Maria"), by consumers and business customers.
§ 2 Conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to order. By submitting your order you make a binding offer; the contract comes into effect with our order confirmation by email.
§ 3 Sale to adults only
We sell alcoholic beverages exclusively to persons who have reached the age of 18. By ordering you confirm that you are of legal age. Delivery is made only after the courier has carried out a visual age check.
§ 4 Prices and shipping costs
All prices are in euros and include statutory VAT; shipping costs are added on top. The applicable shipping costs are shown transparently during the order process before the order is placed.
§ 5 Delivery and limited editions
We deliver within Germany and to selected European countries. Our wines are produced in deliberately limited editions; an offer therefore applies only while stocks last. Should an ordered wine no longer be available, we will inform you without delay and refund any payments already made.
§ 6 Payment
Payment is made using the payment methods offered during the order process. If you choose a method handled by a payment service provider, that provider's terms of use apply in addition.
§ 7 Right of withdrawal
Consumers have a statutory right of withdrawal of 14 days. The period begins on receipt of the goods. A clear statement to info@maria-maria.de is sufficient to exercise it. The buyer bears the cost of return shipping, provided the goods delivered match those ordered.
§ 8 Warranty and liability
The statutory warranty rights apply. For slight negligence we are liable only in the event of a breach of material contractual obligations, and limited to the foreseeable damage typical of this type of contract.
§ 9 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. In relation to consumers, this choice of law applies only insofar as it does not remove the protection of mandatory provisions of the state of their habitual residence.
